Psalms of Heaven / NextView Digital Ventures LLC
These Terms and Conditions ("Terms") govern your access to and use of the Psalms of Heaven website ("Website"), including music, audio recordings, lyrics, artwork, merchandise, digital downloads, personalized content, and other products or services made available through the Website
Psalms of Heaven is owned and/or operated by NextView Digital Ventures LLC ("Company," "we," "us," or "our"). By accessing the Website, creating an account, purchasing a product, downloading content, or otherwise using our services, you acknowledge that you have read, understood, and agree to these Terms.

1. Website Use

You may use the Website only for lawful purposes and in accordance with these Terms. You may not attempt to interfere with Website security, circumvent technological protections, obtain unauthorized access to content, scrape or systematically extract Website content, or use the Website in a manner that violates applicable law or the rights of another person or entity

2. Music and Digital Content

Unless a product page or separate written license expressly states otherwise, purchasing or downloading music from Psalms of Heaven provides you with a limited, non-exclusive, non-transferable license for personal, non-commercial use. Purchasing a song does not transfer ownership of the underlying composition, sound recording, lyrics, artwork, trademark, brand, or other intellectual-property rights.

3. Prohibited Uses

Without prior written authorization or an applicable separate license, you may not resell, redistribute, upload, sublicense, or commercially exploit downloaded music; claim any song, recording, lyrics, artwork, or other protected content as your own; distribute purchased files through file-sharing services or unauthorized download sites; use music in advertisements, films, television programs, monetized videos, commercial social-media content, podcasts, games, apps, or other commercial productions; create unauthorized derivative works from protected portions of the content; or remove copyright, trademark, attribution, digital-rights-management, or other proprietary notices. Customers interested in commercial use should contact questions@psalmsofheaven.com regarding an appropriate license.

4. Intellectual Property

The Website and the protectable human-authored content, branding, logos, designs, compilations, arrangements, text, and other proprietary materials associated with Psalms of Heaven are owned by or licensed to NextView Digital Ventures LLC or the applicable rights holder, except where otherwise stated. Nothing in these Terms should be interpreted as asserting copyright protection over material that is not eligible for copyright protection under applicable law.

5. Artificial Intelligence and Creative Technology

Certain content offered through the Website may incorporate material created, enhanced, modified, arranged, produced, or otherwise developed using AI systems or other digital creative technologies. The Company does not represent or warrant that every element of such content qualifies independently for copyright protection or that every AI-assisted output is exclusively human-authored. Where applicable, the Company claims rights only to the extent permitted by applicable law, including rights arising from human authorship, selection, coordination, arrangement, editing, modification, production, branding, contractual rights, licenses, or other legally protectable interests. The Company intends to comply with applicable disclosure and registration requirements concerning AI-assisted works.

6. Third-Party Rights

Psalms of Heaven seeks to respect the intellectual-property and publicity rights of others. Any reference to third-party names, trademarks, platforms, products, or services does not imply sponsorship, affiliation, or endorsement unless expressly stated. If you believe content available through the Website infringes your intellectual-property rights, contact questions@psalmsofheaven.com with sufficient information to identify the content and your claimed rights.

7. Digital Purchases and Downloads

Because digital products are delivered electronically and may become accessible immediately after purchase, all digital music and lyric purchases are generally final and non-refundable once the digital content has been delivered, accessed, or downloaded, except where required by law or where the file is defective, inaccessible, or the incorrect product was delivered. Nothing in this policy limits rights that cannot legally be waived under applicable consumer-protection law

8. Merchandise

Physical merchandise may be manufactured and fulfilled by third-party print-on-demand providers. Product appearance, sizing, manufacturing, fulfillment, shipping, returns, and delivery times may therefore be subject to the policies and capabilities of the applicable fulfillment provider. Specific merchandise return/refund terms should be displayed separately before purchase.

9. Custom Lyrics and Personalized Services

Custom lyric-writing or personalized music services may be subject to separate order terms describing payment, revisions, delivery times, ownership, permitted use, exclusivity, cancellation, and licensing. Unless expressly transferred through a separate written agreement, purchasing a custom service does not automatically constitute an assignment of all intellectual-property rights.

10. Charitable and Community Initiatives

Psalms of Heaven and/or NextView Digital Ventures LLC may voluntarily dedicate portions of revenue or profits to charitable organizations, community initiatives, individuals in need, or other community-support efforts. Unless expressly stated otherwise at the time of purchase, a purchase from Psalms of Heaven constitutes payment for goods or services and is not itself a charitable donation, and no representation is made that a purchaser will be entitled to a charitable tax deduction. Any specific charitable campaign, designated beneficiary, percentage commitment, or donation program may be governed by additional disclosures or terms.

11. Pricing and Payment

Prices are displayed at checkout and may change without prior notice. Applicable taxes, shipping charges, and other fees will be disclosed where required. Payments may be processed through third-party payment processors. The Company does not necessarily directly store complete payment-card information

12. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Website and its content are provided on an "as is" and "as available" basis without warranties of uninterrupted availability or that all content will meet every user's individual expectations. Nothing in these Terms excludes warranties or rights that cannot legally be excluded

13. Limitation of Liability

To the fullest extent permitted by applicable law, NextView Digital Ventures LLC and its members, officers, employees, contractors, and affiliates shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Website, digital content, merchandise, or services. Where liability cannot lawfully be excluded, liability shall be limited to the maximum extent permitted by applicable law

14. Indemnification

To the extent permitted by law, users agree to indemnify and hold harmless NextView Digital Ventures LLC and its affiliates from third-party claims, losses, liabilities, or reasonable expenses arising from the user's unlawful use, unauthorized redistribution, commercial exploitation, infringement, or violation of these Terms.

15. Third-Party Services

The Website may integrate or link to third-party providers for payment processing, music distribution, streaming, print-on-demand fulfillment, analytics, email, hosting, or other services. Those services may be governed by their own terms and privacy policies, and the Company is not responsible for matters outside its reasonable control.

16. Changes to These Terms

We may modify these Terms periodically. Updated Terms will be posted on the Website with a revised effective date. Continued use following an update constitutes acceptance to the extent permitted by law

17. Governing Law

These Terms shall be governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable law requires otherwise
